By using the website or placing an order, you acknowledge these Terms subject always to mandatory rights that cannot legally be waived.

1. Scope

These Terms apply to:

  • Website visitors;
  • Customers;
  • Purchasers;
  • Account holders; and
  • Other persons using services provided through mlle-champetrex.shop.

Additional policies, including our Privacy Policy, Return and Refund Policy and Shipping Policy, form part of the framework governing use of the store where relevant.

2. Eligibility

You may use the store only if you possess the legal capacity required to enter into the relevant transaction.

Where an individual lacks full contractual capacity, use should occur only as permitted by applicable law and, where required, with appropriate authorisation.

3. Product Information

We make reasonable efforts to provide clear information concerning available products.

Product information may include:

  • Description;
  • Images;
  • Materials;
  • Dimensions;
  • Size;
  • Colour;
  • Care information;
  • Availability; and
  • Price.

Photographs are illustrative representations.

Reasonable differences resulting from lighting, screen display or normal production variation may occur.

This clause does not restrict rights relating to products that are defective, misdescribed or otherwise legally non-conforming.

4. Prices

The price applicable to a product is the price displayed during the ordering process when the order is submitted, subject to applicable law and correction of obvious errors.

Where legally required, applicable taxes and mandatory charges will be included or disclosed before the customer becomes bound by the purchase.

5. Orders

Before submitting an order, customers have an opportunity to review relevant order details.

Customers are responsible for checking:

  • Products selected;
  • Quantity;
  • Size;
  • Colour;
  • Shipping information;
  • Billing information;
  • Price; and
  • Contact information.

We may decline or cancel an order where there is a legitimate reason, including:

  • Product unavailability;
  • Obvious pricing error;
  • Suspected fraud;
  • Payment failure;
  • Legal or regulatory restrictions; or
  • Inability to fulfil the transaction.

Where an order has been paid but is lawfully cancelled by us, the relevant payment will be refunded in accordance with applicable law.

6. Electronic Contract

Orders placed electronically are subject to applicable rules governing ecommerce contracts.

French rules require certain electronic contracts of €120 or more to be archived by the professional for the legally prescribed period and made accessible to the consumer under the applicable conditions.

7. Payment

Available payment methods are displayed at checkout.

Customers agree to provide accurate payment information and represent that they are authorised to use the selected payment method.

Payment may be processed by Shopify Payments or another third-party payment provider.

Fraud-prevention measures may be applied where reasonably necessary.

8. Shipping

We provide free standard shipping on all orders.

The standard estimated delivery timeframe is 15–20 calendar days.

Additional information appears in our Shipping Policy.

Applicable French consumer law concerning agreed delivery periods and delayed delivery remains fully applicable.

9. Risk and Delivery

Risk associated with goods passes in accordance with applicable mandatory consumer law.

Where goods are delivered to a consumer using a carrier offered or arranged by the seller, mandatory consumer protections concerning transfer of risk remain unaffected by these Terms.

10. Right of Withdrawal

Consumers purchasing qualifying products online generally have at least 14 calendar days to exercise the statutory right of withdrawal, subject to applicable exceptions.

The detailed procedure is contained in our Return and Refund Policy.

Nothing in these Terms reduces or replaces that statutory right.

11. Statutory Guarantees

Products sold to consumers are subject to mandatory statutory protections where applicable.

In France, the legal guarantee of conformity generally provides protection for two years following delivery.

Consumers may also benefit from the legal guarantee relating to hidden defects.

Commercial warranties, if any are expressly offered, exist in addition to and do not replace statutory guarantees. French authorities specifically distinguish optional commercial warranties from mandatory legal guarantees.

12. Returns and Refunds

Returns and refunds are governed by our Return and Refund Policy and applicable mandatory law.

Where our policy provides greater protection than the statutory minimum, the more favourable voluntary provision may apply according to its stated terms.

13. Customer Accounts

Where customer accounts are available, users are responsible for:

  • Providing accurate information;
  • Maintaining the confidentiality of account credentials;
  • Restricting unauthorised access; and
  • Informing us promptly of suspected account compromise.

We may take reasonable security measures concerning accounts where fraud or unauthorised activity is suspected.

14. Acceptable Use

Users must not use the website to:

  • Commit fraud;
  • Violate applicable law;
  • Interfere with website security;
  • Upload malware;
  • Attempt unauthorised access;
  • Scrape or overload the website through abusive automated activity;
  • Infringe intellectual-property rights; or
  • Impersonate another person.

15. Intellectual Property

Unless otherwise stated, website content made available through mlle-champetrex.shop, including original text, layout, graphics and store-created materials, may be protected by applicable intellectual-property laws.

Access to the website does not transfer ownership of intellectual-property rights.

Nothing in these Terms prevents use permitted by mandatory law.

16. Third-Party Services

The website may integrate services supplied by third parties, including:

  • Shopify;
  • Payment processors;
  • Shipping providers;
  • Analytics services; and
  • Other technical providers.

Third-party services may be subject to separate terms or privacy information.

We are not responsible for matters controlled exclusively by an independent third party, except to the extent applicable law places responsibility on us.

17. Accuracy and Availability

We make reasonable efforts to maintain website availability and accuracy.

However, temporary interruption may occur because of:

  • Maintenance;
  • Technical problems;
  • Internet failures;
  • Security incidents;
  • Third-party outages; or
  • Events beyond reasonable control.

Nothing in this provision excludes obligations that cannot legally be excluded.

18. Liability

Nothing in these Terms excludes or limits liability where exclusion or limitation would be unlawful.

In particular, these Terms do not limit mandatory rights concerning:

  • Consumer protection;
  • Fraud;
  • Intentional misconduct;
  • Personal injury where liability cannot legally be excluded;
  • Statutory guarantees; or
  • Other non-excludable obligations.

To the extent permitted by law, we are not responsible for losses that are not a reasonably foreseeable consequence of our breach.

The protections afforded to consumers under mandatory French and EU law prevail over conflicting contractual language.

19. Force Majeure

We are not responsible for failure or delay caused by an event qualifying as force majeure under applicable law, to the extent and for the period permitted by law.

Where such an event affects an order, we will take reasonable steps to communicate with the customer and perform or resolve the order consistently with applicable consumer rights.

20. Personal Data

Personal data is processed in accordance with our Privacy Policy and applicable data-protection law.

21. Changes to These Terms

We may update these Terms prospectively where reasonably necessary.

Changes do not retroactively remove rights already acquired under a completed transaction unless legally permitted.

The Terms applicable to an order will generally be those in effect when that order is placed, subject to mandatory law.

22. Consumer Complaints

Customers should first contact:

info@mlle-champetrex.shop

We will make reasonable efforts to review and resolve complaints.

French professionals dealing with consumers are required to provide access to an approved consumer-mediation mechanism and communicate the relevant mediator's contact details to consumers.

The specific mediator must be the mediator genuinely appointed by the business and cannot lawfully be invented in these Terms.

23. Applicable Law and Jurisdiction

These Terms are intended to operate consistently with applicable French and European consumer law for customers in France.

Nothing in these Terms deprives a consumer of mandatory protections granted by the law that would otherwise apply to that consumer.

Any jurisdiction clause is subject to mandatory rules concerning consumer disputes and access to competent courts.

24. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain effective to the extent permitted by law.

The invalid provision will be interpreted or limited only to the extent necessary to comply with applicable law.

25. Entire Agreement

These Terms, together with incorporated store policies and the information provided during checkout, constitute the contractual framework governing purchases through mlle-champetrex.shop, subject to applicable mandatory law.
